Terms of Service

1. Acceptance of Terms

By accessing or using the FiberNode platform and website (fibernode.io), you agree to be bound by these Terms of Service. If you are using the platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

FiberNode is a traceability and compliance platform for fashion and textile brands. The platform enables product data management, Digital Product Passport (DPP) generation, supplier compliance tracking, and regulatory reporting for EU ESPR compliance.

FiberNode is a compliance tool, not legal advice. While we design the platform to align with ESPR requirements, you are responsible for ensuring your compliance with applicable regulations. Consult qualified legal counsel for regulatory guidance.

3. Accounts and Access

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

• You must provide accurate and complete information when creating an account
• You must not share your account credentials with unauthorized parties
• You must notify us immediately of any unauthorized access to your account

4. Free Pilot

FiberNode offers a free 60-day pilot with full platform access. No credit card is required. The pilot includes up to 50 products, dedicated onboarding, and direct support.

At the end of the pilot period, you may choose to continue with a paid plan or discontinue use. Your data will be retained for 30 days after the pilot ends, allowing you to export it or transition to a paid plan.

5. Payment and Pricing

After the pilot, FiberNode operates on a usage-based pricing model. Pricing details are provided during onboarding and may vary based on the number of products, suppliers, and features used.

We reserve the right to update pricing with 30 days written notice. No long-term contracts are required unless explicitly agreed upon.

6. Your Data

You retain full ownership of all data you upload to the FiberNode platform, including product information, supplier data, certifications, and compliance records. We process this data solely to provide you with our services.

You can export your data at any time in standard formats. Upon account termination, we will delete your data within 30 days unless retention is required by law. See our Privacy Policy for details on data handling.

7. Intellectual Property

The FiberNode platform, including its software, design, documentation, and branding, is owned by FiberNode and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the platform for your internal business purposes during your subscription period.

8. Limitation of Liability

FiberNode is provided "as is" and "as available." We make no warranties regarding uninterrupted service, error-free operation, or fitness for a particular regulatory purpose.

To the maximum extent permitted by law, FiberNode's total liability for any claims arising from your use of the platform shall not exceed the total fees paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement at any time with 30 days written notice. We may suspend or terminate your access immediately if you violate these terms or engage in activities that harm the platform or other users.

Upon termination, your right to access the platform ceases. We will retain your data for 30 days to allow export, after which it will be permanently deleted.

10. Governing Law

These Terms are governed by the laws of Spain and the European Union. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the platform at least 30 days before they take effect. Continued use of the platform after changes become effective constitutes acceptance.
